Common Mistakes Made in Divorce

DivDecree

If you are headed for divorce, you may be wondering what to do and how to do it.  Take some guidance from the information below about common mistakes made in divorce and how to avoid them.

Not Following Court Orders

Court orders are orders for a reason.  Not doing what your divorce judge told you to do can get you held in contempt of court, thrown in jail, ordered to pay fines, ordered to pay your spouse’s attorney’s fees, or subjected to whatever other punishment the court believes is warranted under the circumstances. Plus, it does not endear you to the judge. Later on, when you need the judge to decide some other issue in your case, don’t think that the judge won’t remember that you blew off his or her orders in the past.

Not Being Willing to Compromise on Anything

Divorce requires compromise on at least some things.  Unless your spouse totally caves on everything (not very likely) you are going to have to have some give and take.  The more you dig your heels in, the longer your divorce will take and the more money you will spend trying to get everything done.  Even if you refuse to compromise, the judge at trial will eventually invent compromises, some of which you will not be happy with.

Not Verifying Numbers on Your Budget and Balance Sheet

You may not be the one handling the finances in the relationship.  It may put you at a disadvantage in the divorce.  But you can help yourself by keeping a detailed log of all of your incoming and outgoing expenses.  Making a budget based upon what you think or remember will be unhelpful.  You need to verify that these numbers are accurate in order for them to be useful.

Telling Your Kids Horrible Things about Your Spouse

When you do this, you hurt your kids by putting them in the middle of the divorce.  If you need it, get help from a mental health professional like a therapist to help you get your emotions out in a healthy way.  Not only will sharing things about your spouse with your kids hurt them, it will not endear you to the judge going forward.

Not Understanding the Tax Implications of Your Divorce Settlement

There are several tax implications of divorce that you need to be aware of.  You can hire a financial advisor to assist you with these things.  Or your attorney can be of assistance in understanding these important implications.  But either way, you might need some help getting an understanding of these issues.

Not Getting an Attorney

The best thing you can do if you’re thinking about getting a divorce is to find an experienced family law attorney.  Don’t try to do things on your own, even though DIY divorce is all the rage right now.  Find an experienced professional to helm your ship and take care of your assets and the implications for your children.  Reach out to the Atlanta divorce attorneys at the Solomon Firm LLC today for help.
